A complete copy of these rules can be obtained at the offices of KJHM – Jammin’ 101.5 (“Station”), owned and operated by MAX MEDIA llc. or one of its subsidiary companies, 3033 S. Parker Road Suite 700 Aurora, CO 80014, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.
The Station will conduct Cha Cha’s Fly Mama 2013 (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:
1. No purchase is necessary. Void where prohibited. All federal, state, and local regulations apply.
2. Only legal U.S. residents age 18 or older with a valid Social Security number at the time of entry are eligible to participate in Station contests. Employees, agents, representatives, or affiliates of the Station, MAX MEDIA LLC., its subsidiaries and affiliates, participating sponsors, other radio stations, television stations and print advertising companies serving the metro area, and their immediate family members and household members are not eligible to participate. The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.
3. An individual may win an on-going contest only once per six-month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the contest. The Station reserves the right to limit the number of times an individual may enter a contest or drawing.
4. The contest will begin at 6AM (MST) on April 24th, 2013 and will run through 3PM(MST May 9th, 2013 (the “Contest Period”).
5. There is one (1) way to enter this Contest:
(i) Visit Jammin1015.com during the Contest Period and fill out the submission form. Once approved, your photo will be voted on by other users. Each user will be allowed one vote per day, throughout the Contest Period.
6. On May 9th, 2013, one (1) entrant will be selected from all qualifying submissions with the highest vote total, as our grand prize winner. Nine (9) entrants will be selected for our secondary prize, from all qualifying submissions, with the nine highest vote totals after the grand prize winner. If it is determined that the candidate is not eligible to receive either of the prizes, in the Station’s sole judgment and discretion, another candidate will be randomly selected for eligibility consultation and this process will continue on until such time as an eligible candidate is found. In the unlikely event that no candidates are found to meet the specifications, then the prize will go un-awarded. In the event of a tie, the winner will be determined by and at the Station’s sole discretion.
7. (i)One (1) grand prize will be awarded. The grand prize package consists of the following: (2) Tickets to see Prince, May 12th at the Ogden Theatre in Denver, and two (2) Tickets to the Denver Improv to see Jay Phillips, on May 11, 2013, plus appetizers, and drinks. All expenses and fees associated with the grand prize not expressly included in the foregoing prize description are the sole responsibility of the winner. Total grand prize is valued at $660.00.
(ii)Nine (9) secondary prizes will be awarded. The secondary prize consists of the following: (2) Tickets to the Denver Improv to see Jay Phillips, on May 11, 2013, plus appetizers, and drinks. The value of the secondary prize is $100.00
8. Odds of winning depend on a number of factors including the number of eligible entries received and listeners participating at any given time.
9. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
10. All prizes are awarded “as is.” Prizes are nontransferable and cannot be exchanged. No substitute prize will be awarded to a winner who declines to accept a prize. The Station reserves the right to require contestants to be present at drawings in order to win their prize. The Station shall not be responsible for the failure of participating sponsors to deliver the prizes or any part thereof as described herein.
11. All prizes must be claimed in person at the Station at the address identified above during regular business hours and within ten (30) business days of winning, excluding holidays, unless otherwise agreed to by the Station at its sole discretion. After such time, ownership of said prize reverts back to the Station to be disposed of at its discretion. The winner then loses all claims and rights to said prize. Proper identification must be presented by any winner to claim prize. As a condition to receiving any prize, each potential winner must complete and sign a Winner’s Affidavit and Release, releasing the Station from all liability in connection with winner’s participation in the contest and acceptance, use, or non-use of the contest prize.
12. All entrants and winners agree that the Station shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, wining or losing any contest and/or by the acceptance, use, or non-use of any prize received in connection with this contest.
13. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Station to be used, disposed of or destroyed in its sole discretion. The Station is not responsible for any incorrect or inaccurate information entered by website users, and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Station’s website.
14. By participating in a Station contest in which text-message-based entry is permitted, entrants acknowledge that text messages are distributed and delivered through third party providers. Station does not guarantee, nor shall Station be in any way responsible for, the delivery or timeliness of any text message entry. Station will at all times consider the time that a message is logged as arriving in its system as being the time of entry, regardless of the time at which the entrant attempted to send the entry and any technical problems or other complications that may have delayed its delivery. Station is not responsible for service outages, message failures, transmission delays or any other factor affecting the availability or performance of the text messaging service. By participating in Station contests, entrants agree that the Station may contact that entrant at the telephone number from which the text message entry was received. All entrants and winners agree to give the Station and its licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish their name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Station deems necessary without compensation, unless prohibited by law. All winners release, discharge, and agree to hold the Station harmless from any and all claims they may have against the Station in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live. 17. By participating in the Contest, participants agree to be bound by the decisions of Station personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Station’s decisions concerning such disputes shall be final. 5. There is one (1) way to enter this Contest:
(A) Listen to Jammin 101.5 for the cue to call during the Contest Period and be the designated caller to qualify to play. The designated caller will then select a two game tile numbers. The object of the game is to match revealed prizes.
6. Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize. The Station and prize providers are not responsible for phone line failures, electrical outages, natural disasters or acts of man or God.
7. 49 prizes will be awarded pending the revelation of all game tiles. All game tiles may not be revealed based on the number of correct callers and chances to win. If any provision of this Agreement, or the application thereof to any person or circumstances, is held invalid or for any reason, unenforceable including, but not limited to, the warranty disclaimers and liability limitations, then such provision shall be deemed superseded by a valid, enforceable provision that matches, as closely as possible, the original provision, and the other provisions of this Agreement shall remain in full force and effect. The failure of either party to insist upon strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. International Use/U.S. Export Controls

101.5 FM contests are open to all 101.5 FM listeners who reside in Colorado and are at least 18 years of age. Employees of 101.5 FM, its licensee, the Max Radio of Denver LLC, participating sponsors/promotional partners, affiliated advertising agencies, other radio stations in the Denver Metro Area and members of their immediate families are ineligible to participate or win.
Listeners are eligible to win a 101.5 FM contest once every thirty days (unless the prize is judged by 101.5 FM to be insignificant). Persons who have won a prize valued up to $100, and any members of their household are not eligible to win for the next 30 days. Persons who have won a prize valued between $101 and $499 are not eligible to win for the next 90 days. Persons who have won a prize valued between $500 and $999 are not eligible to win for the next 6 months. Persons who have won a prize valued at $1000 or more are not eligible to win for the next 12 months. All prizes valued over $600 must have a W-9 form filled out prior to receiving prize.
Contestants may be required to sign a release form waiving 101.5 FM of any liability for injury or death caused during the contest or by use of the prize. Contestants may be required to present a valid ID or Colorado driver’s license.
All prizes should be picked-up at the office of 101.5 FM during normal office hours (Monday-Friday from 9am-5pm, excluding Holidays) at 3033 S. Parker Road, Suite 700, Aurora, CO 80014. The winner will forfeit any prize not claimed within 30 days of winning or by time designated to each contest.
Contest prizes are not transferable. Prizes may not be substituted for or redeemed for cash 101.5 FM reserves the right to substitute a prize or prizes of equivalent or greater value.
Decisions of 101.5 FM station management with respect to contests are final.
Payment of all federal, state, and local taxes is the sole responsibility of the winner. Winners are required to sign an IRS Form 1099 or the equivalent if prize or combination of prizes for the current calendar year totals over $599.
By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any broadcasting or advertising material relating to this contest without additional financial or other compensation, and to sign a publicity release prior to acceptance of the prize.
Contest winners (and their travel companions, if any) will be required to sign a liability release prior to acceptance of any prize valued at $600 or greater or which prize includes the provision of transportation, whether or not such transportation is provided by 101.5 FM. Pursuant to the liability release, the winners will agree to hold 101.5 FM, its corporate licensee, the Max Radio of Denver LLC, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or contest.
101.5 FM reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.
